Respondent B E F O R E HON’BLE MR. JUSTICE A. GUNESHWAR SHARMA ORDER 20.01.2026 [1] Present Mr. H. Dijen, learned counsel for the petitioners and Mr. SM Fariz, learned counsel for the respondent. [2] Earlier the parties have arrived a settlement in mediation proceeding dated 01.12.2025. However, vide order dated 08.12.2025, this Court was referred the case to the same mediator for reframing the terms of settlement. Consequently, in mediation proceeding dated 14.01.2026, the parties have entered into a fresh terms of settlement and the same is reproduced below: “TERMS OF SETTLEMENT 14-01-2026 The Civil Revision is put up before me for mediation as per the Notification dated 16-07-2025 issued by the Secretary, High Court Legal Service Committee, High Court of Manipur for conducting mediation. The petitioners namely (i) Yumnam Ongbi Sasuma Devi, (ii) Elizabeth Yumnam and Solomon Yumnam as well as the respondent Yumnam Indrajit Singh are present during the mediation. During the process of mediation, the parties have come to an amicable Settlement under the following terms and conditions. That, it is agreed between the parties that the Revision Petition (FAM) No. 1 of 2023 filed by Yumnam Ongbi Sasuma Devi and her two children namely (i) Elizabeth Yumnam and Solomon Yumnam against Yumnam Indrajit Singh have agreed to withdraw/dispose the Revision Petition (FAM) No. 1 of 2023 filed before the Hon'ble High Court of Manipur in terms and conditions of this mediation agreement. 2. That, Yumnam Indrajit Singh will pay a sum of Rs. 5,000 (Rupees five thousand) only per month as maintenance allowances to Yumnam Ongbi Sasuma Devi till she re- marries and also a sum of Rs. 5,000 (Rupees five thousand) each to Elizabeth Yumnam and Solomon Yumnam, who are his daughter and son till they are able to earn themselves. It is also agreed between the parties that Yumnam Indrajit Singh will pay a sum of Rs. 2 lacs to be paid in 20 instalments to Yumnam Ongbi Sasuma Devi and her children namely (i) Elizabeth Yumnam and Solomon Yumnam i.e Yumnam Indrajit Singh will pay a sum of Rs. 15,000/- + Rs. 10,000/- = Rs. 25, 000/- each per month starting from December, 2025 till the 2 lacs is recovered. After completion of payment of Rs. 2 lacs in 20 (twenty) instalment, then he will continue to pay Rs, 15,000/- as stipulated above. The monthly maintenance allowances will be transferred to the joint saving account bearing A/C No. 10608023605 of the Manipur State co-operative Bank Ltd. 3. That, it is also agreed amongst the parties that the MC (CRP (CRP Art. 227)) No. 36 of 2023 and its related Revision filed by Yumnam Indrajit before the Hon'ble High Court against Elizabeth Yumnam and Solomon Yumnam will be withdrawn by Yumnam Indrajit as not pressed. 4. That, it is also agreed that the Elizabeth Yumnam and Solomon Yumnam will transferred a piece of land measuring 0.62 acres on the eastern side from agricultural land of Phourel class under Patta No. 166 (Old) corresponding New Patta No. 462 covered by C.S Dag No. 1188 measuring 2.82 acres situated at Revenue Village No. 25- Kabowakching of which is recorded in their name to one Nongthombam Ibopishak Singh of Kabowakching, P.O & P.S Nambol, Bishnupur District, Manipur. Any money incurred in the said transaction will not be borne Elizabeth Yumnam and Solomon Yumnam. The remaining agricultural land measuring 2.20 acres will be owned and recorded in the name of Elizabeth Yumnam and Solomon Yumnam of which the share of Elizabeth Yumnam will be 0.62 acres on the eastern portion and Solomon Yumnam will be the remaining western portion measuring 1.58 acres. Yumnam Indrajit Singh will not claim any share in the said agricultural land. 5. That, the Cril Execution case No. 5 of 2025 filed by Yumnam Ongbi Sasuma Devi, Elizabeth Yumnam and Solomon Yumnam which is pending before the Family Court, Manipur at Lamphelpat will be withdrawn by Yumnam Ongbi Sasuma Devi, Elizabeth Yumnam and Solomon Yumnam as not pressed. It is also agreed amongst the parties that they will not file any case and counter case relating to any matters which are compromised or settled through this mediation. But, it is also agreed that if the parties fail to comply with the term and condition of this compromise agreement, then the party will be responsible for all consequences. The above terms and conditions are read and explained to the parties and they have put their respective signature in their sound state of mind and without any inducement and after knowing the contents of the settlement. Hence, the mediation is hereby settled. Parties are to appear before the Hon'ble High Court.” [3] In terms of the above settlement in mediation proceeding dated 14.01.2026, the present RP(FAM.CT.)
