The petitioners herein are students who joined the M.B.B.S course at Rajah Muthiah Medical College & Hospital, Chidambaram, affiliated with Annamalai University, during the academic years 2018–2019, 2019–2020, and 2020–2021. Being Aggrieved by G.O.(Ms).No.204 dated 26.10.2021, issued by the Higher Education (H1) Department of Tamil Nadu, which fixed the fees for these students at Rs.4,00,000/- (per annum), they are before this Court seeking a writ of Certiorarified mandamus to quash the said order and for direction to the respondents to collect only Rs.13,610/- per annum and not to withhold their certificates insisting payment of higher fees. 2. Before we advert to the merits of the case, it is pertinent to trace the background and reasons for issuing the impugned Government Order. 3. Annamalai University is a Private University established in the year 1929 by a Statute called “Annamalai University Act, 1928”. Under its aegis, Rajah Muthiah Medical College & Hospital, Chidambaram was established in the year 1985 for offering M.B.B.S, B.D.S and other paramedical courses. It was functioning as a private Medical College, collecting capitation fees from the students. W.P.No.18395 of 2023 etc., batch, Government by enacting Annamalai University Act, 2013 (Tamil Nadu Act 20/2013) which came into effect from 25.09.2013. Thereafter, the said private university attained the status of State University. 4.
When dispute arose regarding fixation of fees for the students joined in the said College after the take-over by the Government, the Hon’ble Supreme Court, in Civil Appeal No.6654 of 2018 dated 13.07.2018, passed the order as below:-
“We hold that the University was not entitled and competent to devise its own fee structure in the present matter without having the fee fixed by the Committee on Fixation of Fee as contemplated under 1992 Act. The matters shall therefore have to be referred to said Committee and the University is directed to place the entire material including its balance-sheet and accounts before the Committee on Fixation of Fee within two weeks from the date of this Judgment. The Committee shall thereafter bestow attention and fix appropriate fee structure for the academic year 2013-14 onwards. It goes without saying that if the fee structure fixed by the University is found by the Committee to be inappropriate, consequential benefit and advantage shall be given to each and every student. The Committee shall fix the appropriate fee structure for the current academic Session 2018-19 as well. 5. In view of the above direction by the Hon’ble Supreme Court, the committee headed by a retired Judge of the Madras High Court constituted for the fixation of fees. The said Committee on getting clarification from the Government about the status of the Rajah Muthiah Medical College, which continued to be a self-finance mode college even after the enactment of the Tamil Nadu Act 20/2013) and on considering the income and expenditure statements of the said University, after hearing the representatives of the students, fixed Fees for M.B.B.S, course for the respective academic years as below:- The Fee fixed for M.B.B.S Course from the year 2013-2014 to 2018-2019, Academic Year 2013-2014 2014-2015 2015-2016 2016-2017 2017-2018 2018-2019 Fee Fixed Rs.
4,50,000 5,08,000 5,44,370 5,44,370 5,44,370 5,44,370 Note: For the academic year 2015-2016, 2016-2017 and 2017-2018 though the expenditure arrived at is over and above the fee prescribed in the prospectus. The Committee fixed the fee at Rs.5,44,370/-.(Five Lakh Forty Four Thousand Three Hundred and Seventy Only) The fee fixed for the year 2017-2018 is applicable for the year 2018- 2019 also. If any fee collected over and above the fee fixed by the Committee shall be refunded to the students. W.P.No.18395 of 2023 etc., batch, to remit the same. Wherever the fee arrived by the Committee is more than the fee already fixed by the institution the Committee fix the same fee as fixed by the institutions printed in the prospectus considering the interest of the students.”

Pointing out the disparity in the fee structure between the private unaided Medical Colleges and the Rajah Muthiah Medical College, some of the students filed writ petitions and that writ petitions reached finality before the Hon’ble Supreme Court in B.Mohammed Naveeth & others vs. The Chairman, Fee Fixation Committee for Medical Colleges & others (order dated 10/12/2018), with the following observation:-
“Following is the statement of the Fee Fixation Committee placed on record on behalf of the petitioner:- MBBS(UG) Academic Year 2013-2014 (Rs.) 2014-2015 (Rs.) 2015-2016 (Rs.) 2016-2017 (Rs.) 2017-2018 (Rs.) 2018-2019 (Rs.) Govt. W.P.No.18395 of 2023 etc., batch, Considering the aforesaid disparity, we, prima facie, find no justification for fixing the higher fees for Rajah Muthaiah Medical College as compared to the private unaided medical colleges for MBBS (UG), BDS (UG), Medical (PG), MDS (PG). We direct, by way of an interim measure, that the fees that has been fixed for the private unaided medical colleges for MBBS (UG), BDS (UG), Medical (PG), MDS (PG) shall be realized by the University/College from the students and not even a penny more, during the pendency of this writ petition.”

Thus, as per the direction of the Supreme Court, a fee of Rs.4,00,000/- was collected from the students who joined the M.B.B.S., course in Rajah Muthiah Medical College & Hospital from the academic year 2018-2019. While so, in tune with the decision of the Government, the Rajah Muthiah Medical College, attached to the Annamalai University, was took over by the Government and renamed as ‘Government Medical College in Cuddalore District’ vide G.O.Ms.No.16 (Higher Education Department), dated 27/01/2021. By this Government Order, the administration, along with the assets and liabilities of the College, was handed over to the Health and Family Welfare Department. Consequently, G.O.(Ms).No.45, dated 01.02.2021, was issued by the Health and Family Welfare Department, wherein the fees for the M.B.B.S, course was fixed at Rs.13,610/-(per annum), on par with the prevailing fee structure for the existing Government Medical Colleges. “4. After careful examination of the proposal of the Director of Medical Education, the Government hereby accord administrative sanction on the following: …… (b) The fees structure above will be given prospective effect from the date of taking over of the said Colleges as Government institutions/colleges as per the Government Order referred above. The earlier existing fees prior to taking over, already paid by the students will not be refunded or adjusted against future payments. The benefit of Government fee structure as fixed from time to time will be extended to currently studying and forthcoming students.”
8. As amendment to the above paragraph 4(b) of G.O.(Ms).No.45, dated 01.02.2021, the Health and Family Welfare (MCA-2) Department came out with clarification G.O.(Ms).No.122, dated 26.02.2021, adding clause (c) which read as below:-
Order: The following amendment is issued to G.O. (Ms).No.45, Health and Family Welfare (MCA2) Department, Dated 01.02.2021 AMENDMENT In the Government Order second read above, after the para 4(b) the following shall be added:-
“(c) Any earlier unpaid fees will be charged as per the earlier structure prior to issue of the Government

Referring the above three Government Orders, viz., G.O.(Ms).No.16 (Higher Education [H1] Department), dated 27.01.2021, G.O.(Ms).No.45, Health and Family Welfare (MCA-2) Department, dated 01.02.2021 and G.O. (Ms).No.122, Health and Family Welfare (MCA2) Department, dated 26.02.2021, the Higher Education (H1) Department issued G.O.(Ms).No.204, dated 26.10.2021, which is impugned in these batch of writ petitions. 10. Some of the students who joined the Rajah Muthiah Medical College in the academic years 2018-2019, 2019-2020 and 2020-2021 had filed writ petitions stating that, the order of the Hon'ble Supreme Court in Aamira Fathima v. Annamalai University, reported in 2018 (9) SCC 171, to fix fees for the students of Rajah Muthiah Medical College & Hospital on par with self- finance unaided Medical Colleges, hold good only till the college took over by the Government. Once the private college became a Government College, the fees from the students currently studying in the said College must be par with Government Colleges and not higher than the fees collected from similarly placed students studying in the other Government Medical Colleges. The G.O. (Ms).No.45, Health and Family Welfare (MCA-2) Department, dated 01.02.2021 passed consequent to the handing over of the College by the Annamalai University to the Government, had fixed the fees for the current students and forthcoming students as Rs.13,610/-. It is further clarified in G.O. (Ms).No.122, dated 26.02.2021, that the new fees structure will be given effect prospectively. Therefore, students who are pursuing their M.B.B.S. course, currently irrespective of their year of joining, are liable to pay only Rs.13,610/- as the annual fees. In other words, the claim of the writ petitioners is that, the effect of G.O.(Ms).No.45, dated 01.02.2021, issued by the Health and Family Welfare (MCA-2) Department, is applicable to all students pursuing their studies in the College (2nd year to 5th year) and for the students joining the college in future.

W.P.No.18395 of 2023 etc., batch, Higher Education (H1) Department had fixed fees at Rs.4,00,000/- to the students joined in the academic years 2018-2019 to 2021-2022, on par with self- finance college fees, which is arbitrary and discriminatory. They further claim that, similarly placed students of 'Perundurai Medical College, Erode' who joined that College in the academic year 2019-2020, the Government has issued G.O.(Ms).No.84, dated 20.02.2021 and collecting Rs.13,610/- only. Whereas, from the petitioners who are pursing the M.B.B.S., course in Rajah Muthiah Medical College (renamed as Government Medical College, Cuddalore) have been discriminated and compelled to pay higher fees without any reasonableness. Hence, G.O.(Ms).No.204, dated 20.10.2021, is liable to be quashed. 12. Mr.S.R.Rajagopal and Mr.Arvind Pandian Learned Senior Counsels appearing for the writ petitioners contented that, the Annamalai University after taken over by the Government has become a State University. Consequently, the Medicine Faculty of the University and the College run by the University has become part of the Government. The status of the Medical College before its takeover by the Government was different, the higher fees fixed and collected were justifiable. However, after its takeover by the Government vide G.O.(Ms).No.16, Higher Education (H1) Department, dated 27.01.2021, the students currently pursing the courses in the College has to be treated at par with the Government Medical College students and cannot be discriminated. _____________ Page Nos.47/60 https://www.mhc.tn.gov.in/judis
W.P.No.18395 of 2023 etc., batch, Further, they argued that classifying students who joined before take over and who joined after take over lacks reasonableness. After issuing G.O.(Ms).No.45, dated 01.02.2021, that the fees fixed at Rs.13,610/- will apply to all the students studying currently, the Government, being a welfare state, cannot arbitrarily withdraw the promise and fix higher fees arbitrarily. 13.
On behalf of the writ petitioners, it was also canvassed before us that, in W.P.No.7539 of 2021 filed by Chaavi Pareek and 144 others, the Deputy Secretary to Government, Health and Family Welfare Department, filed counter affidavit wherein, referring G.O.(Ms).No.45, had sworn that the Government have fixed the fees structure applicable to Government Medical institutions to courses offered in the Rajah Muthiah Medical College & Hospital, Chidambaram, with prospective effect. In the same writ petition, the Registrar- in-Charge of Annamalai University, filed counter affidavit wherein he also sworn that the writ petitioners have already paid their first-year fees and for the second year, the University is going to collect the fees as per G.O.(Ms).No.45, dated 01.02.2021 and G.O.(Ms).No:122, dated 26.02.2021. Therefore, when clarification sought by the writ petitioners from the Government about the fees structure for the writ petitioners who joined the M.B.B.S. course in the year 2019-2020, taking into consideration the above submission and the G.O. (Ms).No.45, the Hon'ble Division Bench of this Court, while disposing of W.P.No.7839 of 2021 on 01.09.2021 had recorded the submissions made by the _____________ Page Nos.48/60 https://www.mhc.tn.gov.in/judis
W.P.No.18395 of 2023 etc., batch, Government and the Annamalai University, extracting the fees structure table as found in G.O.(Ms).No.45, dated 01.02.2021. 14. The Learned Counsels for the writ petitioners, referring the G.O. (Ms).No.84, Health and Family Welfare Department, dated 20.02.2021, issued in respect of Perundurai Medical College established by the Institute of Road Transport, submitted that, G.O.(Ms).No.64 is similarly worded as G.O. (Ms).No.45, in which the students who joined in Perundurai Medical College were asked to pay only Rs.13,600/- as per G.O.(Ms).No.45. In contra, for the students of Rajah Muthiah Medical College, Chidambaram, though earlier it was clarified that the fees structure will be as per G.O.(Ms).No.45, through impugned G.O.(Ms).No.204, the fees is enhanced without any intelligible differentia. 15.
In response to the above arguments, the Learned Advocate General for the State clarified that, the Rajah Muthiah Medical College, Chidambaram, remained as a self-finance college, till it was taken over by the Government and renamed as 'Government Medical College Cuddalore'. The said College got affiliated to the Dr.M.G.R Medical University through Act 23 of 2021, which came into effect from 26.02.2021. The students who got admitted to the M.B.B.S. course prior to the date of its affiliation to Dr.M.G.R Medical University continue to be the students of Rajah Muthiah Medical College under _____________ Page Nos.49/60 https://www.mhc.tn.gov.in/judis
W.P.No.18395 of 2023 etc., batch, Annamalai University. Therefore, they cannot claim any parity with the students who joined the Government Medical Colleges in the State under the Government Quota. Insofar as Perundurai Medical College, it was established by Institute of Road Transport (IRT), functioning under the Tamil Nadu Transport Department and was always part of the Government and been affiliated to Dr.M.G.R.Medical University from its inception. Later, that college was taken over by the Government to be run directly. Hence, that College, which was a self-finance Medical College till then, on its take over by the Government from IRT, the students were treated par with the students pursuing their courses in other Government Medical College. Accordingly, the writ petitioners who joined the Rajah Muthiah Medical College affiliated to Annamalai University cannot seek parity with the students who joined in colleges affiliated to Dr.M.G.R Medical University. A conjoint reading of the Government Orders passed in respect of take over and fees structure, along with the order passed by the Hon'ble Supreme Court in this regard, it will be clear that the writ petitioners who joined the Rajah Muthiah Medical College under the aegis of Annamalai University are class by themselves and cannot claim parity with the students joined to the renamed Government Medical College, Cuddolore, under the aegis of Dr.M.G.R Medical University. 16.
Further, the Learned Advocate General also submitted that, the writ petitioners, relying on the expression found in para 4(b) of G.O.(Ms).No.45, _____________ Page Nos.50/60 https://www.mhc.tn.gov.in/judis
W.P.No.18395 of 2023 etc., batch, that, "the benefit of the Government fees structure as fixed from time to time will be extended to currently studying and forthcoming students", refers only to the students who joined the Government Medical College, Cuddalore, under Dr.M.G.R Medical University. To make it clear, the amendment was brought to the above Government Order by clause (c) after clause (b) in paragraph 4. Still, the ambiguity prevailed, therefore G.O.(Ms).No.204 was passed by the Higher Education Department, which is the Department competent to decide about the fees structure for the Medical Colleges run by the Government. 17. The Learned Advocate General submitted that, the process of taking over the Rajah Muthiah Medical College was completed only after carving out the college from the management of the Annamalai University. This process includes the delinking the financial affairs, staff, land and buildings, followed by shifting its affiliation from Annamalai University to Dr.MGR Medical University. Those who joined the Rajah Muthiah Medical College & Hospital, Chidambaram affiliated to Annamalai University, based on the prospectus which has prescribed the annual fee as Rs.4,00,000/-, continue to be students of Rajah Muthiah Medical College affiliated to Annamalai University till they complete the course. 18. Heard the rival submissions made by the respective Learned Counsels on either side. 19. The Annamalai University and the medical college run by the Annamalai University, after the take over, had faced several changes which not only confined to its administration but also its finance and the mode of admitting the students.
After the Annamalai University (Second Amendment) Act, 2013, G.O (Ms).No.16, dated 27.01.2021 issued by the Higher Education Department renaming the 'Rajah Muthiah Medical College, Chidambaram' as 'Government Medical College, Cuddalore'. Thereafter, the Government Medical College, Cuddalore, got affiliated to Dr.M.G.R Medical University, by amendment to the Dr.M.G.R Medical University Act and thereafter, those students got admitted after 2021-2022 were treated as students of Government Medical College, Cuddalore. While so, the G.O.(Ms).No.204, dated 26.10.2021, issued by the Higher Education Department which is impugned in these writ petitions had made clear that fees for the students who joined prior to academic year 2020-2021 will be collected as per the prospectus and the fee committee recommendations. The programs to which students were admitted till the year 2020-2021 may continue to be affiliated to Annamalai University. The Undergraduate and Postgraduate courses in the Medical and Dental faculties should be affiliated to the Dr.M.G.R Medical University from the batch to be admitted from the academic year 2021-2022. W.P.No.18395 of 2023 etc., batch, College & Hospital, to which the writ petitioners got admitted and Annamalai University, to which the said affiliated, shall remain so till these students complete their courses. 20. In respect of the W.P.No.7539 of 2021, filed by Chhavi Pareek and 144 others, who were the M.B.B.S. students joined in Rajah Muthiah Medical College during the academic year 2019-2020, we find that, the writ petitioners had sought for a direction to Dr.M.G.R Medical University to conduct examination. The Hon’ble Division Bench of this Court had negatived their prayer, holding that the affiliation of the said college to Dr.M.G.R Medical University is only prospective. Therefore, the students who joined the college before affiliation to Dr.M.G.R Medical University shall continue to be the students of Annamalai University. 21.
In our considered view, the said observation of the Hon’ble Division Bench of this Court gives quietus to the contention raised by the writ petitioners. 22. G.O.(Ms).No.45, Health and Family Welfare (MCA-2) Department, dated 01.02.2021, has to be read in entirety and not selectively. Thus, on reading the above Government Order, it is clear as crystal that, first, by G.O.(Ms).No.16, dated 27.01.2021, the Government has changed the name of the College and decided to treat it as regular Government Medical College. Next, proposal was sent by the Director of Medical Education to adopt the Government fees structure and other charges from the date of issue of G.O. (Ms).No.16, dated 27/012021. Thereafter, amendment to G.O.(Ms).No.45 by adding clause(c) and finally, G.O.(Ms).No.204, dated 26.10.2021 was issued. All these Government Orders were passed with prospective effect. They joined the College after knowing that the fees for their course is Rs.4,00,000/- per annum as mentioned in the prospectus issued for the respective academic years. 24. In G.O.(Ms).No.45, at para 4(b), it is stated that the conferment of the benefit of the fees structure is extended to the students currently studying and forthcoming students. This provision has to be read and understood in the light of paragraphs 2 and 3 of the same Government Order as well as clause (c) which was subsequently added by way of amendment through G.O. (Ms).No.122.
Thus by reading conjointly, we find no illegality in G.O. (Ms).No.204, dated 26.10.2021, which confines the benefit of Government college fee structure to the students who joined the Government Medical College, Cuddalore, affiliated to Dr.M.G.R Medical University during the academic year 2021-2022 and thereafter and not for those joined the Rajah Muthiah College & Hospital, Chidambaram, affiliated to Annamalai University before 2021-2022. 25. Therefore, we hold the contention raised by the writ petitioners seeking extension of the benefit of G.O.(Ms).No.45, Heath and Family Welfare (MCA-2) Department, dated 01.02.2021 as untenable.
