For Petitioner(s): Ms.D.E.Anishree Sangavi For Respondent(s): N/R/N – For R1 & R2 https://www.mhc.tn.gov.in/judis WP No. 14922 of 2023 __________ Page2 of 4 ORDER The writ petition is filed seeking a writ of mandamus directing respondents to pay interest to the petitioner, in accordance with the provisions of the Land Acquisition Act, in respect of the acquisition of lands comprised in R.S No.55/ 5 for an extent of 0.25.66 hectares situated at Kalapet, Pondicherry, and pass such further or other orders. 2. The learned Counsel for the petitioner would submit that the petitioner’s land comprised in R.S No.55/ 5 for an extent of 0.25.66 hectares, situated at Kalapet, Pondicherry, and other lands in Kalapet Village, have been acquired by the Government for the purpose of establishing a Central University under Phase V of the Land Acquisition Act. She would further submit that an award has been passed vide order dated 01.06.1987, fixing compensation at Rs.318/- per Are for the lands acquired and, thereafter, on 21.11.1994, the compensation was enhanced to Rs.1868/- per Are. She would further submit that for similarly placed persons, this Court, in a batch of writ petitions, directed the respondents to grant interest on the enhanced amount of compensation. Hence, the petitioner submitted a representation dated 08.12.2022 to respondents seeking interest on the enhanced amount of compensation. Heard the learned Counsel for the petitioner and perused the available materials on record. 4. Considering the limited relief sought by the learned counsel for the petitioner, this Court without expressing any opinion on the merits of the case, directs the 2nd respondent to dispose of the petitioner’s representation dated 08.12.2022, after issuing due notice and affording an opportunity of personal hearing to the petitioner as well as the rival claimants, if any, on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
