Learned counsel appearing on behalf of the petitioner contends that the petitioner was nominated as an accused on the disclosure statement of co-accused Samim, who was arrested for being in possession of 254 grams of heroin. In pursuance to the said disclosure, no recovery of any nature whatsoever has been effected from the petitioner and that he has been nominated as an accused only because accused-Samim happens to be the mother of the petitioner herein. It is further alleged that investigation in the present case is complete and even the charges have been framed on 11.02.2026, however, no evidence has been recorded so far. It is contended that there are 25 witnesses to be examined, hence, conclusion of trial shall take long. 4. Learned State Counsel does not dispute the aforesaid facts. 5. I have heard learned counsel appearing on behalf of the respective parties and have gone through the documents appended along with the present petition. 6. Taking into consideration the period of custody already undergone by the petitioner, his clean antecedents, absence of any recovery as well as the stage of the trial, I deem it appropriate to allow the present petition. 7. The instant petition is allowed and the petitioner is ordered to be released on regular bail on his furnishing requisite bail bond/surety bond to the satisfaction of the trial Court/Duty Magistrate, concerned.
