Since the same was not considered, the present writ petition has been filed. 3.Learned Additional Government Pleader appearing for the respondents 1 to 5 would submit that the issue of the petitioner is to remove the encroachment made in the land assigned to the petitioner. The said issue has to be agitated before the Civil Court. 4.In reply learned counsel for the petitioner would submit that the petitioner has succeeded in the civil suit. Therefore, to remove all the encroachment, he has made a representation. 5.Heard the learned counsel for the petitioner, learned Additional Government Pleader appearing for the respondents 1 to 5 as well as the learned counsel for the respondents 6 and 7. 6.Considering the submissions made by either parties, this Court is of the view that if the petitioner succeeded in the civil suit, the right course available for the petitioner is to file the Execution Petition to remove the encroachment. https://www.mhc.tn.gov.in/judis WP No. 12179 of 2023 7.In view of the above, this writ petition is disposed of.
