JUSTICE R.K. PATTANAIK Order No. ORDER 16.04.2026 02. 1. Heard learned counsel for the petitioner and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Puri Town P.S. Case No.380 of 2025 corresponding to G.R. Case No.987 of 2025 pending in the court of learned S.D.J.M., Puri on the grounds stated. 3. Perused the FIR as at Annexure-1. Recorded the submissions of Mr. Mohanty, learned counsel for the petitioner and State. It is submitted that there was a heated an argument exchange between the parties and thereafter, the petitioner said to have committed the alleged mischief, since revealed from the report. From the FIR, the Court finds that the petitioner trespassed into the residence of the informant and did other mischief, such as, having abused him in filthy language. All the offences are bailable in nature except the one under Section 331(6) BNSS related to the house trespass. Considering the above facts and submissions of learned counsel for the respective parties and recording the fact that the petitioner has two other antecedents but not of recent origin and of the year 2020 as informed, this Court, though not inclined to grant pre- arrest bail to him but is of the view that he should be directed to surrender before the learned court bellow for being released with stringent conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned S.D.J.M., Puri in connection with Puri Town P.S. Case No.380 of 2025 corresponding to G.R. Case No.987 of 2025 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.40,000/-(rupees forty thousand) with one solvent surety for the like amount with other conditions imposed besides the following, such as, he shall not cause any harm to the informant in any manner and commit further mischief involving him while on bail and to furnish an undertaking in that regard at the local PS. It is further directed that the petitioner shall attend the PS once in a fortnight preferably on a Sunday between 10.00 AM to 1.00 PM for the purpose of investigation and to continue to do so, till it is over. It is made clear that if any of the conditions is/are violated by the petitioner, it shall entail cancellation of his bail granted without reference to this Court. 6.
