He further contends that petitioner is not involved in any other case other than the case at hand, hence, there is no reason to assume that there is any possibility of the petitioner indulging in such trade. It is submitted that 14 witnesses are cited by the prosecution out of which none has been examined so far and as such the conclusion of trial shall take long. 4. Learned State Counsel does not dispute the aforesaid facts and is also not in a position to refer to any evidence other than the disclosure statement of the co-accused Rohtash. 5. I have heard learned counsel appearing on behalf of the respective parties and have gone through the documents appended along with the present petition. 6. Taking into consideration the nature of allegations levelled against the petitioner, the period of custody already undergone by him, lack of involvement of the petitioner in any other case under the NDPS Act, the stage of the trial as well as the failure of the prosecution to refer to any evidence other than the disclosure statement of co-accused, I deem it appropriate to allow the present petition. 7. The instant petition is allowed and the petitioner is ordered to be released on regular bail on his furnishing requisite bail bond/surety bond to the satisfaction of the trial Court/Duty Magistrate, concerned. 8.
