Anabaya Chozhan for R3 https://www.mhc.tn.gov.in/judis WP No. 5021 of 2023 ORDER This writ petition has been filed to direct the respondents 1 and 2 to restore the electricity service connection (No. 207) to the property under the possession and enjoyment of the petitioner. 2. The learned counsel for the petitioner would submit that in this case, there is a title dispute, pertaining to the subject property, between the petitioner and the 3rd respondent. The petitioner, being in possession of the said property, had carried on his commercial activities therein, for which, an objection was made by the 3rd respondent, pursuant to which, the electricity was disconnected in the said premises. 3. He would further submit that now the commercial activities of the petitioner was shifted to some other place and the subject property is used only for the purpose of residential activities. Hence, this petition. 4. In reply, the learned counsel appearing for the 3rd respondent would submit that in this case, though the petitioner is in possession of the property, all the EB Bills are generated in the name of 3rd respondent and without the consent of the 3rd respondent, the tariff was converted from residential to commercial. https://www.mhc.tn.gov.in/judis WP No. 5021 of 2023 5. He would also submit that the objection was made only for carrying on commercial activities, however, there is no objection for utilising the subject property for residential purpose. Hence, he requests this Court to pass appropriate orders. 6. Heard the learned counsel for the petitioner and the respondents and also perused the entire materials available on record. 7. In the case on hand, it is clear that the petitioner, being in possession of the said property, had carried on his commercial activities therein, for which, an objection was made by the 3rd respondent, pursuant to which, the electricity was disconnected. However, now the commercial activities of the petitioner was shifted to some other place and the subject property is used only for the residential purpose. 8. In view of the above, the respondents 1 & 2 are directed to consider the petitioner’s request and restore the electricity service connection, within a period of 4 weeks from the date of receipt of a copy of this order. https://www.mhc.tn.gov.in/judis WP No. 5021 of 2023 9.
