That in compliance of above said order it is submitted that the complainant/Respondent No. 2 received a message on his mobile number 8447907638 from WhatsApp number 91- 7880832249. They added him to a WhatsApp group called BlackRock DE Equi Trade 77 through a link and made him download the Alpaxis Pro application, where an account was created for him. This application invests money in the stock market and claims to provide profits. On January 10, 2024, complainant/Respondent No. 2 transferred ₹5000 via NEFT from his HDFC Bank A/C No. 00931140021547 to A/C 2302264454398891, AU Bank, IFSC Code - AUBL0002644. On January 11, 2024, he withdrew ₹500, which was successfully credited to his account. After that, he transferred ₹20000 via NEFT on January 11, 2024, 75000 via IMPS on January 12, 2024, ₹100000 via IMPS on January 12, 2024, and ₹88000 via IMPS on January 17, 2024, from his above-mentioned account. The total amount invested by complainant/Respondent No. 2 is ₹2,88,000/-, During this period, on January 16, 2024, he withdrew ₹43620/- from Alpaxis Pro, which was credited to his account. After that, on 23/1/24, he tried to withdraw his amount of ₹250,000/- from Alpaxis Pro, but then his Alpaxis Pro account was blocked, and he was removed from the WhatsApp group BlackRockDE-Equitrade77. Therefore complainant/ Respondent No. 2 was cheated with total amount of Rs. 2,88,000/-. That there are 28 complaints against the joint account bearing number 8750125495 of Kotak Mahindra Bank of Petitioner No. 1 & 2 used in this crime as per 14C report.” 5. It is evident from the perusal of the above that as many as 28 complaints have been instituted in relation to the aforesaid accounts maintained by the petitioners and numerous persons have been deceived by the petitioners herein. The compromise does not make any reference to the other victims, the compromise is thus partial. SUMIT SINGH GUSAIN 2026.02.23 10:23 I attest to the accuracy and integrity of this document 3 126 CRM-M-72959-2025(O&M) 6. In view of the judgment passed by the Division Bench of this Court in CRM-M-48043-2025 titled as ‘Rakesh Das Vs. State of Haryana and another (alongwith 33 connected cases)’, a quashing on the basis of partial compromise can otherwise be not allowed. 7. The present petition is accordingly dismissed at this stage. 8. Pending application(s), if any, shall also stand disposed of. (VINOD S.
