The learned counsel for the petitioner would submit that in this case, the petitioner is the owner of the land in survey Nos.123/15 & 123/7A2B1A measuring to an extent of 970 sq.m. Out of the said land, the 3rd respondent had acquired a small portion of land, measuring to an extent of 302 sq.m. The remaining land to an extent of 668 sq.m was left out. Under these circumstances, the petitioner, by virtue of representations dated 18.10.2022 & 04.02.2023, had requested to sub-divide the land and issue patta for the same. However, the said representations were not at all considered by the 7th respondent till date. Hence, this petition. 3. The learned counsel appearing for the 3rd respondent had confirmed the submissions made by the petitioner and would submit that at present, they have no objection for sub-dividing the left out portion of land. Further, he would submit that if any more land is required for any public purpose, in future, the same will be acquired by them by following due process of law. Hence, he requests this Court to pass appropriate orders. 4. Heard the learned counsel for the petitioner and the respondents and also perused the entire materials available on record. 6. In the case on hand, the petitioner is the owner of the land, in survey Nos.123/15 & 123/7A2B1A, measuring to an extent of 970 sq.m. Out of the said land, the 3rd respondent had acquired the land to an extent of 302 sq.m. The remaining land to an extent of 668 sq.m was left out. Hence, the petitioner, by virtue of representations dated 18.10.2022 & 04.02.2023 had requested to sub- divide the left out portion of land and issue patta for the same. 7. Further, it was submitted by the 3rd respondent that they have no objection in sub-dividing the left out portion of land. In such case, there is no impediment on the part of the 7th respondent in sub-dividing the remaining portion and issue patta in favour of the petitioner. 8. In view of the above, this Court directs the 7th respondent to consider the petitioner's representations dated 18.10.2022 & 04.02.2023 and take action to sub-divide the land and thereafter, issue patta in favour of the petitioner within a period of 8 weeks from the date of receipt of a copy of this order. https://www.mhc.tn.gov.in/judis WP No. 13744 of 2023 9.
