1. Heard learned counsel for the State.
2. By means of this application, the Petitioner seeks the following relief:
“The petitioner, therefore, prays that Your Lordship‟s may graciously be pleased to admit the writ application, call for the records and after hearing the parties, allow the same and issue a writ in the nature of Certiorari/Mandamus or any other or further writ/writ(s), direction/directions directing quashing of the impugned
order dated 13.04.2023 passed in Demarcation Case No.10/2021 by Tahasildar, Jaleswar rejecting the Time petition filed on the first date of „appearance and allowed for demarcation and further direct the Tahsildar, Jaleswar to hear the demarcation case afresh allowing time petition to engage Advocate on behalf of the petitioner and giving due opportunity of hearing to the petitioner as per provision of law for the interest of justice.
And pass any other order(s), direction (s) as this Hon‟ble Court may deems fit and proper in the facts and circumstances of the case.”
3. The writ application was filed in the year 2023. Defects were pointed out by the Stamp Reporter, which have not been removed despite lapse of considerable time.
4. Having regard to the nature of the prayer and considering that the Petitioner has not pursued the matter for all these years, this Court is of the view that the cause of action may no longer survive. Accordingly, the writ petition stands disposed of as infructuous.
