Mr. D.K. Das, Advocate

Mr. J. Khandayatray, ASC
CORAM:
THE HON’BLE MR. JUSTICE CHITTARANJAN DASH
Order No.
ORDER 07.03.2026
01.
1. The inaction of the Tahasildar, Puri, has been called in question in the present application and the Petitioner seeks the following prayer:-
“Under the aforesaid facts and circumstances, the Petitioners therefore pray that this Hon’ble Court may graciously be pleased enough to admit the case, issue notice to the Opposite Parties and after hearing the Advocates for the parties, this Hon’ble Court may further be pleased to direct the Opposite Parties to issue the mutated R.o.R in favor of Petitioner no.1 & 2 in respect of the property under the Deed of Gift in question.”
2. As seen from the application, the Petitioner, by virtue of a gift deed, intends to get the land recorded in his name and accordingly approached the concerned Tahasildar for effecting the mutation in his favour. However, it is stated at the Bar that the matter is pending before the Tahasildar and has not been disposed of. The Petitioner, therefore, seeks a p. 2 direction to the Tahasildar to dispose of his mutation application in accordance with law pursuant to the Gift deed in his favour in question.
3. Having regard to the submissions made by the learned counsel for the Petitioner and the prayer made therein, in the absence of any serious objection from the side of the State, the Opp. Party No.2 i.e. the Tahasildar, Puri is directed to consider the mutation application, if any, filed by the Petitioner within a period of three months, if there be no other legal impediment and dispose of the same giving an opportunity of being heard to the Petitioner in accordance with law.
4. Accordingly, the Writ Petition stands disposed of.
