03.
1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.
2. Heard learned counsel appearing for the Parties.
3. The present Writ Petition has been filed inter alia with the following prayer:-
“It is, therefore, humbly prayed that this Hon'ble Court may graciously be pleased to issue Rule Nisi calling upon the Opp. Parties to show cause as to why appropriate writ/writs shall not be issued, (i) quashing/modifying the portion of the
order dtd.17.7.2020 under Annexure-16to the extent of "with effect from the date of his joining in Group-C post", ii) and absorb the petitioner in Group-C post Work Charged and pay the salaries prescribed for Group-C category w.e.f 14.2.2011 (iii) and further be pleased to quash the order drd.26.10.2022 under annexure-22, (iv) and consequently direct the opp. parties to regularize the services of the petitioner in regular establishment under Group-C with effect from the date his juniors have
been regularized, taking his date of joining as DLR and date of birth into consideration and place his position appropriately in the gradation list, and release all consequential and financial benefits arising out of same, and on perusal of causes shown if any or upon insufficient causes shown make the said rule absolute and may pass such other order/ orders as deemed just and proper. And for this act of kindness, the petitioners shall as in duty bound, ever pray.”
4. Taking into account the nature of order passed in connected W.P.(C) No.22944 of 2023, this Court while disposing the Writ Petition held the Petitioner entitled to get benefit of absorption as against Group-C post, from the date the Tribunal passed the order on 23.08.2017 under Annexure-7, but on notional basis.
5. Since it is fairly contended that Petitioner in the meantime has got the benefit of regularization, this Court is not passing any order in that regard.
6. This Court directs Opposite Party No.1 to pass a fresh order by bringing over the Petitioner as a Group- C employee from the date of disposal the matter by the Tribunal on 23.08.2017, but on notional basis. This Court directs Opposite Party No.1 to pass a fresh order within a period of two (3) months from the date of receipt of this order.
7. Accordingly, the Writ Petition stands disposed of. (Biraja Prasanna Satapathy) Subrat
