1. Application for grant of stay to the show-cause- notice for dismissal, filed by the petitioner/employee in Complaint (ULP) No.42/2018 vide Exh.U-2, came to be rejected by the learned Judge, Labour Court, Amravati vide order dated 29/11/2018. Revision preferred by the petitioner/employee being Revision (ULP) No.57/2018 came to be rejected by the learned Member, Industrial Court, Amravati vide judgment and
order dated 07/10/2023. These judgments are orders are subject matter of challenge in the present petition.
2. It appears from the record that although application for grant of stay was rejected by the learned Labour Court and the said order was confirmed by the learned Industrial Court, ad interim order of stay is operating in favour of the petitioner till date. This position is operating since the year 2018.
3. In view of the aforesaid, it will be expedient to dispose of the petition by directing the learned Labour Court to 2026:BHC-NAG:8081
39. WP 7020 of 2023.odt 2 decide the preliminary issue with respect to fairness of enquiry and perversity of findings, recorded by the Enquiry Officer, within a stipulated time-frame and by directing the parties to maintain status quo, till such adjudication.
4. The learned Labour Court, Amravati is requested to decide the preliminary issue as early as possible and preferably before 31/08/2026. Status quo with respect to employment of the petitioner shall be maintained till decision on the preliminary issue by the learned Labour Court.
5. Writ Petition stands disposed of accordingly with no
order as to costs.
