By way of filing the instant criminal misc. petition, a challenge has been led to the impugned FIR No.287/2023 registered with Police Station Beawar City, District Ajmer for the offences punishable under Section 376 IPC and 67 of the Information Technology Act. 2. At the outset, learned Public Prosecutor on the basis of the factual report received from the Station House Officer, Police Station, Beawar City, District Beawar submits that after investigation, the Police has proposed the Final Report (Negative), hence, under these circumstances, no cause of action survives (2 of 2) [CRLMP-2364/2023] with the petitioner to continue with this petition and the same has become infructuous. 3. Considering the above factual aspect of the matter, the instant criminal misc. petition is dismissed as having become infructuous. Stay application as well as all pending application(s), if any, also stand dismissed. 4. However the petitioner would be at liberty to move an application for revival of this petition, in case, any cause of action/grievance still survives. 5.
