THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION No.143 of 2023 ORDER: This writ petition is filed seeking to declare the action of the respondent authorities in not approving the petitioner’s application and subsequently releasing the scholarship amount to the petitioner that has been granted under the scheme of overseas education scheme for minority Students for pursuing higher studies abroad from the year 2016-17 which was introduced by way of G.O.Ms.No.33 Minorities Welfare (EDM) Department, dated 29.9.2016 issued for providing financial assistance for minority students for pursuing higher studies courses in foreign universities, for four consecutive academic years from 2018-19, 2019-20, 2020- 21, 2021-22 despite the petitioner has made an application for the said scheme and an e-pass to that effect has been issued in respect of application dated 01.12.2022 and the subsequent action of the Government in issuance of G.O.Ms.No.39 dated 11.7.2022 revamping the orientation of whole scheme and revising the guidelines superseding all earlier guidelines in vogue being violative of fundamental rights of the petitioner and consequently direct the respondent authorities to disburse the scholarship amount in accordance with the scheme. 2. Heard learned counsel for the petitioner and learned Government Pleader appearing for the respondents. 3. During the course of hearing learned counsel for the petitioner submitted that this writ petition is squarely covered by the orders of the writ petition vide W.P.No.38282 of 2022 dated 05.12.2022 and requested to pass similar order as that of the order sin W.P.No.38282 of 2022 dated 05.12.2022. 4. Learned Government Pleader, on instructions, submitted that the proposals are already submitted to the Government, which are under process for release of grant, hence, requested further time. 5. Considering the submissions of both the counsel and on perusal of the material on record, the writ petition is disposed of in the same lines as that of W.P.No.38282 of 2022 dated 05.12.2022 directing Respondents to release the sanctioned funds under the scheme of “Overseas Education Scheme for minority Students for pursuing Higher Studies abroad from the year 2016-17” within a period of six (06) weeks from the date of receipt of a copy of this order. No costs. As a sequel, the miscellaneous applications pending, if any, shall stand closed.
