G.P. for Registration and Stamps The Court made the following: 2 W.P.No.2301 of 2023 ORDER: The writ petition is filed under Article 226 of the Constitution of India, seeking the following relief: “…to issue a writ, order or a direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in refusing to receive, register and release the cancellation of the mortgage deed vide Doc. No. 4523 of 2021, dated 04.10.2021 presented by the petitioner and 4th respondent in respect of property situated in Sy. No. 26/1 and 26/2B to an extent of Ac. 1.98 cents situated at Settivaripalli Village, K.K.V. Puram Panchayat, R.C. Puram Mandal, Tirupati District, is highly illegal, arbitrary, unconstitutional and contrary to the provisions of the Registration Act, 1908 and also violation of Articles 14 and 300-A of the Constitution of India and consequently direct the 3rd respondent to receive, register and release the cancellation of mortgage deed vide Doc. No. 4523 of 2021, dated 04.10.2021 presented by the petitioner and 4th respondent in respect of said property without reference to the pendency of suit in O.S. No. 187 of 2014 on the file of the Family Court -cum- V Addl. District Judge, Tirupati and to pass…” 2. Sri D. Prasad Kumar, learned counsel representing the learned counsel for the petitioner, submitted that no further order is required in this writ petition as the relief sought in the writ petition has become infructuous. 3.
