Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ order or direction more particularly in the nature of WRIT OF MANDAMUS declare the action of the Respondents no.1 and 2 in not taking any legal action against Respondent no.5 herein for having cheated played fraud on the petitioner and respondent no.3 not conducting any enquiry against R-5 vide Rc.No. 103/E1/ADMandHO(AandL)/2018 dt.
24- 10-2018, as illegal arbitrary and unconstitutional and consequently direct the Respondent no.3 to finish the enquiry forthwith against R-5 and to submit a report to the higher authorities and further direct R-1 to take legal action against R-5 thereafter and to pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondent no.3 to finish the enquiry forthwith against R-5 and to submit a report to the higher authorities and further direct R-1 to take legal action against R-5 thereafter pending disposal of the writ petition and pass IA NO: 2 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to permit the petitioner to file in this W.P.No.19196/2023 the pleadings like the petition papers pertaining to the quash petition CrI.P No.3741/2019 which is pending before this honourable court and to pass Counsel for the Petitioner:

THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION NO: 19196/2023 The Court made the following Order:
This Writ Petition is filed aggrieved by the action of the respondent Nos.1 & 2 in not taking any action against the respondent No.5 for having cheated and played fraud on the petitioner and consequently prayed to direct the respondents to finish the enquiry forthwith against the respondent No.5 and to submit a report to the higher authorities. 2. The respondent No.2 filed counter-affidavit stating that charges were framed by the Director of Public Health & Family Welfare, AP Vijayawada vide Rc.No.077/VC.IIA/2018, dated 06.05.2020 and the respondent No.3 was appointed as Regular Inquiry Officer to conduct enquiry against the respondent No.5. The respondent No.3 has issued a notice to the respondent No.5 and disciplinary proceedings is pending for adjudication. 3.
It appears from the material papers filed by the petitioner that a Criminal Case was registered against the respondent No.5 for the offences punishable under Section 498 (A) r/w 34 of Indian Penal Code, 1860 and charge sheet has been filed and the same is registered as C.C.No.394 of 2018 on the file of the learned Special Judicial Magistrate of First Class for Prohibition and Excise, Kadapa, YSR District. 4. As the relief prayed and granted by the respondents, nothing survives in the present writ petition. 4
