The instant application has been filed alleging violation of the directions contained in order dated 2.11.2015 passed in C.W.J.C no. 2914 of 2013 whereby the petitioner was granted liberty to file a comprehensive representation before the respondent District Collector, Saharsa and in turn the District Collector, Saharsa either himself or through any competent
Patna High Court MJC No.330 of 2023(3) dt.19-08-2026 2/3 authority of the respondent State was to consider and decide the claims raised on behalf of the petitioner strictly in accordance with law by a reasoned and speaking order within the time fixed in the said order.
3. At the outset, learned counsel appearing for the opposite parties in reference to the show cause filed on behalf of the opposite party nos. 2, 3, 6 and 7 submits that pursuant to the
order of this Court, a petition was filed by the petitioner raising his grievances. An authorization was issued in favour of the District Land Acquisition Officer, Saharsa wherein Miscellaneous Case no.1 of 2023 was registered and notices were issued to the petitioner and the Circle Officer, Sonbarsa fixing the date for hearing as 10.3.2023. It is further stated that both the parties appeared on 28.3.2023, participated in the hearing and finally by order dated 28.3.2023, Miscellaneous Case no.1 of 2023 was disposed of by the District Land Acquisition Officer, Saharsa.
4. A copy of the order dated 28.3.2023 passed in Miscellaneous Case no.1 of 2023 by the District Land Acquisition Officer, Saharsa has been brought on record as Annexure-A to the show cause, a copy of which has been served on learned counsel for the petitioner.

5. At this stage, it is seriously contended by learned counsel for the petitioner that the directions contained in the
order passed in the writ application have not been complied with insofar as all the points raised by the petitioner have not been considered by the authority concerned in its true letter and spirit.
Learned counsel for the petitioner has tried to argue on the merits of his case which was the subject matter of Miscellaneous Case no.1 of 2023 and which now stands
disposed of by order dated 28.3.2023.
6. In the opinion of the Court, so far as merits of the case of the petitioner is concerned, the same cannot be gone into in the present contempt application. The petitioner will be at liberty to challenge the same in accordance with law.
7. The respondents having passed final order dated 28.3.2023 passed in Miscellaneous Case no.1 of 2023, in the opinion of this Court, the directions contained in order passed in the writ application stands complied with.
8. The application stands disposed of.
