1. The Writ petition has been filed for setting aside the order dated 05.09.2023 passed by the Learned Commissioner, Tirhut Division, Muzafarpur by which the selection of the petitioner as a PDS dealer in Panchayat Chandparna, by the Selection Committee Muzaffarpur has been set aside and further be pleased to restore the PDS license of the petitioner being License No.23-09- 09-07/2020.
2. It is submitted by the Learned counsel
Patna High Court CWJC No.17311 of 2023(7) dt.21-08-2026 2/3 for private respondent No.5 that respondent No.5 is no longer interested in contesting the matter, as he has joined as a Teacher.
3. However, during the course of
arguments, it is noticed that the Writ petition has been filed challenging the selection of respondent No.5. As respondent No.5 himself has left the P.D.S. dealership and joined as a Teacher, the post shall remain vacant. Since the petitioner stood at Serial No.2 and respondent No.5 stood at Serial No.1 and respondent No.5 has voluntarily left the post of P.D.S. dealership, the Selection Committee is
directed to consider the matter in accordance with law.

Therefore, the Learned counsel for the petitioner is directed to make a representation before the Selection Committee/District Magistrate within a period of one month from the date of receipt of this order. In turn, the Selection Committee/District Magistrate shall consider the matter and pass an appropriate order within three months from the date of filing of such

5. With the abovesaid observation, the Writ petition stands disposed of.
