ANSHUMAN ORAL ORDER 2 28-07-2026 Heard learned counsel for the petitioner and learned counsel for the State. 2. The present writ petition has been filed for the following relief/s:- “I. That this writ application is being filed for issuance of a writ in the nature of “mandamus” commanding and directing the Patna High Court CWJC No.17695 of 2023(2) dt.28-07-2026 2/3 respondent authority to select the petitioner for the post of Farmer Adviser (Kisan Salahkar) on the basis of advertisement published in the year 2014 whereby and whereunder respondent nos. 4 to 9 who have obtained lesser marks point that this petitioner and selected on the post of Farmer Adviser for the financial year 2014-15 is the District of East Champaran. I/A. For commanding the District Respondent to give the petitioner made treatment as has been given to the candidates who have got lesser marks point than the petitioner on the ground of equity. 1/B. For and also for consequential service benefit and monetary relief to the petitioner like other candidates who have got lesser marks to the petitioner to the post of farmer adviser against advertisement published in the year 2014. 1/C. For issuance of any other writ / writs, relief / reliefs, order / orders, direction/ directions for which the petitioner is found to be entitled in the facts and circumstances of the case.” 3. Learned counsel for the State raised preliminary objection and submits that counter affidavit has been filed in which Annexure- R/A is annexed which is an advertisement for Patna High Court CWJC No.17695 of 2023(2) dt.28-07-2026 3/3 appointment of the Farmer Adviser (Kisan Salahkar). Counsel specifically submits that the dispute in the present writ petition is for appointment on the post of Farmer Adviser (Kisan Salahkar). For the said post, advertisement was made vide Memo No. 633 dated 09.10.2014. He submits that the requisite qualification for the post was a full time course namely, B.Sc. Agriculture / B.Sc. Horticulture / B.Sc. Agriculture Engineering / B.Sc. Animal Husbandry / B.Sc. Fisheries / B.Sc. Gabya Technology / B.Sc. Ecology / B.Sc. Botany / I.Sc. Agriculture, which is described in serial no. 1 of Annexure- R/A. He submits that on the other hand, the claim which has been made by the petitioner is on the basis of vocational course which is not permissible according to the advertisement. 4. Upon perusal of the advertisement annexed as Annexure- R/A, it transpires that the vocational course is not permissible. As such, the petitioner has no case at all. 5.
