1. Present petition has been filed challenging the
order dated 16th May, 2023 in Title Suit No. 1175 of 2021 whereby the learned Trial Court though allowed the adjournment sought on behalf of the plaintiff/petitioner but did not allow the counter objection to the objections filed by the defendant.
2. Learned counsel submits that if he is not allowed to refute the objections taken by the defendant he will not be able to present his case.
3. The Court considers the submissions. Let the petitioner be allowed to raise all the objections during the course of argument to the objections filed by the defendant to the application filed under Order 39 Rule 1 and 2 C.P.C.
4. Learned counsel submits that in view of this he does not want to press this application further.
5. In view of the submissions this petition is
disposed of.
6. It is made clear that this Court has not gone into the merits of the case and no expression made herein shall tantamount to be in expression on the merits of the case.
