The Court:- Supplementary affidavit filed in Court today is taken on record. This is an application for grant of probate of the last Will and Testament dated February 18, 2012 left behind by the above-named deceased. The Will was registered in the Office of the Additional Registrar of Assurances-III, Kolkata on February 18, 2012. The testator is survived by four legal heirs who have been described in paragraph 7 of the application. The mother of the testator predeceased him. The wife of the testator also expired on November 18, 2020. Her death certificate has been brought on record by way of a supplementary affidavit. Out of the four legal heirs (i.e. one son and three daughters) described in paragraph 7 of the application, one is the executor and the other three have consented to the grant by filing affidavits of consent. The Will has been proved in common form by one of the attesting witnesses. Having regard to the above and since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the 2 department, therefore, considering the view of the department, this application for grant of probate is allowed by passing orders in terms of prayer (a) of the petition.
