Mr. Subhamay Patra, Adv. …for the applicant The Court:- Supplementary affidavit filed in Court today is taken on record. This is an application for grant of probate of the last Will and Testament dated April 10, 2015 left behind by the abovenamed deceased. The testator is survived by four legal heirs who have been described in paragraph 6 of the application. The widow of the testator met her demise on February 23, 2018. A copy of the death certificate of the widow of the deceased has been brought on record by way of a supplementary affidavit. The mother of the testator predeceased him. Out of the four legal heirs (i.e. three sons and one daughter) who have been described in paragraph 6 of the application, one is the executor and the other three have consented to the grant by affirming affidavit of consent. 2 The Will has been proved in common form by one of the attesting witnesses. In such view of the matter, since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the Department, therefore, having regard to the above and considering the view of the Department, this application for grant of probate is allowed by passing orders in terms of prayer (a) of the application.
