The testator is survived by four legal heirs who have been described in paragraph no.6 of the application for grant of probate. The mother of the testator has predeceased him. One of his sons named in paragraph no.6 of the application is the executor. The other three legal heirs, namely, his wife and two other sons have consented to the grant by filing affidavits of consent. The Will has been proved in common form by affidavits of two attesting witnesses. Having regard to the aforesaid and since the file has been placed before this Court by the Registrar-in-Insolvency for grant, upon complete scrutiny by the department, therefore, considering the view of the department, this application for grant of probate is allowed by passing orders in terms of prayer (a) of the petition.
