Ms. Durga Chowdhury, Adv. …for the petitioner The Court:- This is an application for grant of probate of the last Will and testament dated January 28, 2016 of the abovenamed testator. The Will has been registered in the office of the Additional Registrar of Assurance-III, Kolkata. The testator is survived by three legal heirs whose details have been provided in paragraph 7 of the application for grant of probate. The Will has been proved in common form by one of the attesting witnesses. The only son of the testator (who is one of the legal heirs) is the executor. The widow of the testator has filed affidavit of consent. The only daughter of the testator has not filed her affidavit of consent but has also not lodged any caveat despite citation having been issued. A “No Caveat Certificate” has also been issued by the Department in this regard. In view of the above and since the matter has been placed before this Court by the Registrar Insolvency for grant after complete scrutiny by the Department, therefore, considering the aforesaid and the view of the 2 Department, the application for probate is allowed by passing order in terms of prayer (c) of the petition.
