The Will has been registered in the office of the Additional Registrar of Assurances- III, Kolkata on September 7, 2017. The husband of the testatrix had pre-deceased her. The testatrix is survived by two legal heirs who have been described in paragraph 5 of the petition. Both the legal heirs who have been described in paragraph 5 have filed their affidavits of consent thereby consenting to the grant. The Will has been proved in common form by the affidavits of the two attesting witnesses. No caveat certificate has also been issued upon issuance of citation. Since the files have been placed before this Court by the Registrar Insolvency, upon complete scrutiny for grant, therefore, considering the view of the Department, the application for grant of probate is allowed by passing order in terms of prayer (a) of the petition.
