R7 IS IMPLEADED AS PER ORDER OF THIS COURT DT.23.09.2023 VIDE ORDER PASSED IN I.A.NO.2 OF 2023 ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue an order, writ or direction, more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents particularly respondent no 1 to 4 not taken any action against the 5th respondent society fraudulent transactions violating the APCRDA Act and other statutory principles is illegal arbitrary and violative of Articles 14, 16, and 21 of the Constitution of India and further declare that the 5th respondent society committed irregular fraudulent transactions and (ii)Direct the respondents 1 to 4 to appoint an inquiry committee against the fraudulent transactions happened in the 5th respondent Society and take action accordingly (iii)Direct the respondents to release the mortgage transaction between 5th and 6th respondent and protect the rights of the petitioners by declaring the action of 61h respondent auctioned the reserved plots for amenities under APCRDA Act is illegal, and misconceive and pass such other order or orders may deem fit and proper in the circumstances of the case.
