G V S KISHORE KUMAR The Court made the following: 3 THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA CONTEMPT CASE NO:2750/2023 ORDER: This contempt case is filed against the respondents for willful disobedience of the orders dated 05.12.2022 passed by this Court in W.P.No.39224 of 2022. 2. Heard learned counsel for the petitioner and learned counsel for the respondents. 3. When the matter is taken up for hearing, it is observed that the order impugned in the present contempt case was challenged by way of writ appeal i.e., W.A.No.606 of 2023, wherein, the Division Bench of this Court was pleased to pass an interim order staying the operation of the orders passed by this Court in the Writ Petition in the year, 2023. It is further observed that although an interim order was passed in the writ appeal in the year, 2023, so far, the interim order was neither vacated nor any further orders were passed in the Writ Appeal. 4. The contempt petition has been posting from time to time for awaiting the result of the Writ Appeal and posted more than twenty times after the interim orders passed in Writ Appeal dated 11.10.2023. Even today, neither the interim order passed in the writ appeal has been vacated nor passed any further directions. 4 5. In view of the pendency of the writ appeal and the subsistence of the interim stay, once the order of this Court has been stayed, the same cannot be enforced in the present contempt proceedings. Therefore, no further orders are necessary at present in the present contempt case. 6. Accordingly, the present contempt case is closed. There shall be no order as to costs.
