This is an application filed under Section 389 of the CrPC praying for suspension of sentence dated 02.09.2021 passed by the learned Special Judge, PoCSO, Golaghat, Assam in PoCSO Special Case No. 75/2016 and to allow the applicant Sri Karan Garh @ Tufan to go on bail. I have gone through the judgment and have considered the submissions made by the learned counsel for both the sides. The learned Additional Public Prosecutor has raised objection against the prayer of the applicant. Considering entire aspect of the matter, the sentence imposed upon the applicant Sri Karan Garh @ Tufan by the learned Special Judge, PoCSO, Golaghat, Assam in PoCSO Special Case No. 75/2016 shall remain suspended till disposal of the connected Criminal Appeal No. 199/2021. Page No.# 3/3 In view of the above, the applicant Sri Karan Garh @ Tufan, who is in jail in connection with PoCSO Special Case No. 75/2016, is allowed to go on bail of Rs.50,000/- with one surety of like amount to the satisfaction of the learned Special Judge, PoCSO, Golaghat, Assam.
