1. This Writ Petition has been filed primarily challenging proceedings under Securitization and Reconstruction of Financial

Assets and Enforcement of Security Interest Act, 2002 (for brevity “SARFAESI Act”), undertaken by respondent Bank against respondent No.3 (borrower). It is further prayed that action of bank, in refusing to receive a cheque issued by petitioner for discharging of debt, should be declared illegal.
2. It had been pointed out by learned counsel for respondent Bank that present petitioner lacks bonafides. It is submitted that petitioner has filed O.S.No.1846 of 2022 against respondent seeking recovery for an amount of Rs.20,00.000/- and on the other hand, has filed present writ petition.
3. As none had been appearing on behalf of petitioner on various occasions, following order was passed on 21.04.2026.
“None had appeared on behalf of petitioner on last date of hearing. The matter was adjourned for today with an observation that in case, there is no representation on behalf of petitioner and
arguments are not addressed, the petition may be dismissed in default and for non-prosecution. Today again, there is no representation on behalf of petitioner. In the interest of justice, matter is adjourned to 23.04.2026 under the caption „for dismissal‟.”
4. Today, Mr. T. Lakshmi Narayana, learned counsel, appears on behalf of petitioner and submits that despite various efforts, petitioner has not contacted him and he therefore pleads no instructions in this matter.

5. Keeping in view the facts and circumstances as above, and specific stand of learned counsel for petitioner, this writ petition is dismissed for non prosecution. No order as to costs.
6. Pending applications, if any, are disposed of accordingly.
