The Court made the following: 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL REVISION CASE NO: 1220/2023 JUDGMENT: This Criminal Revision Case has been filed under Sections 397 & 401 of Criminal Procedure Code seeking to challenge the Judgment, dated 14.09.2023 passed in Crl.A.No.86 of 2019 on the file of the learned VIII Additional District and Sessions Judge, Chittoor, confirming the Judgment passed by the learned IV Additional Judicial Magistrate of First Class, Chittoor dated 07.03.2019 in C.C.No.03 of 2017 (STC No.414 of 2016). 2. Heard the learned counsel for the petitioner, learned Assistant Public Prosecutor for the State and learned counsel for the respondent Nos.2 to 4. 3. The petitioner/accused and respondent Nos.2 to 4/complainants are present. They have compromised the matter. The petitioner/accused has submitted Rs.11,00,000/- (Rupees Eleven Lakhs only) Demand Draft to the respondent Nos.2 to 4/complainant in the Court hall and the respondent Nos.2 to 4 received the same. 4. The respondent Nos.2 to 4/complainant is permitted to compromise the matter with the petitioner/accused under Section 320(6) of Criminal Procedure Code (for short 8the Cr.P.C.9), read with Section 147 of Negotiable Instruments Act. 4 5. In that view of the matter, the Criminal Revision Case is allowed in terms of compromise. Further the respondent Nos.2 to 4/complainant are directed to withdrawn Rs.2,00,000/- (Rupees Two Lakhs only), which was already deposited by the petitioner/complainant before the trial Court. The petitioner/accused is directed to pay an amount of Rs.30,000/- towards costs to the Secretary, High Court Legal Services Committee, High Court of Andhra Pradesh and furnish the receipt of such payment to the Registry. The Secretary, High Court Legal Services Committee, High Court of Andhra Pradesh is directed to spend this amount for the welfare of the children in the Government Home to provide any amenity or purchase clothes or books or any other things to attend their needs. 6. The learned counsel for the petitioner/accused submitted the receipt of Rs.30,000/- which was issued by the Secretary, High Court Legal Services Committee, High Court of Andhra Pradesh and the same is placed on record. 7. Accordingly, the petitioner is acquitted under Section 320(8) of 8the Cr.P.C.9. The Judgment, 14.09.2023 passed in Crl.A.No.86 of 2019 on the file of the learned VIII Additional District and Sessions Judge, Chittoor, confirming the Judgment passed by the learned IV Additional Judicial Magistrate of First Class, Chittoor dated 07.03.2019 in C.C.No.03 of 2017 (STC No.414 of 2016) are set aside. 5 Consequently, miscellaneous applications pending, if any, shall stand closed. __________________________________________ DR.
