No. 68 situated at Erramanchi Village Village, Penugonda Mandal, Sri Satya Sai District without issuing any notice and without conducting any enquiry in respect of Petitioners Land admeasuring Ac. 15.70 cents as illegal, arbitrary, violation of principles of natural justice and violation of Articles 14, 21 and 300A of the Constitution of India and set-aside the same consequently direct the Respondent No. 4 to issue the pattadar passbooks and title deeds to the Petitioners in respect of land 3 admeasuring Ac.15.70 cents in in Sy. PILLIX LAW FIRM The Court made the following: 4 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India for the following relief/s: "….to issue order or direction more particularly in the nature of Writ of Mandamus, declaring the action of the Respondent Nos.4 in passing the Endorsement dated 21.01.2023 vide Rc.No.262/2022/B and deciding the shares of Petitioners and un-official Respondents and confirming lesser land to the Petitioners @ Ac.7.85 cents instead of Ac.15.70 cents in Sy.No.68 situated at Erramanchi Village Village, Penugonda Mandal, Sri Satya Sai District without issuing any notice and without conducting any enquiry in respect of Petitioners Land admeasuring Ac.15.70 cents as illegal, arbitrary, violation of principles of natural justice and violation of Articles 14, 21 and 300A of the Constitution of India and set-aside the same consequently direct the Respondent No.4 to issue the pattadar passbooks and title deeds to the Petitioners in respect of land admeasuring Ac.15.70 cents in Sy.No.68 situated at Erramanchi Village Village, Penugonda Mandal, Sri Satya Sai District and pass such other orders….." 2. Both the learned counsel for the petitioners as well as the unofficial respondent unison have consented and agreed for disposal of the Writ Petition by setting aside the impugned proceedings and remand 5 the matter to the Tahsildar to consider the case afresh after giving opportunity of hearing to both the parties. 3. In view of the above consent and submission made by both the learned counsels, the impugned proceeding dated 21.01.2023 is hereby set aside and the matter is remanded to the Tahsildar to consider the same afresh and the Tahsildar is hereby directed to consider the objections raised by the petitioners as well as the unofficial respondents including the proceedings of the LRT and pass appropriate orders in accordance with law, as expeditiously as possible. This order is passed on the consent of both the counsel for the petitioners and the unofficial respondents. 4. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
