None appears for the petitioner on second call also. Ms. P. Chakraborty, learned counsel appearing for the Water Resources Department is present. Ms. Chakraborty, the learned counsel has submitted that the office of the Executive Engineer, Golaghat Water Resources Division has informed the
learned counsel that they have not been able to trace out the papers relating to the application filed by the petitioner for pay protection. This Court notices that in the absence of the documents before the respondents authorities no adjudication can be made at this stage. Therefore this writ petition, in the absence of the learned counsel for the petitioner on two calls today, is disposed of, granting the liberty to the petitioner to resubmit the requisite documents before the Office of the Executive Engineer, Golaghat Water Resources Division within a period of 1 (one) month from the date of this order. On the receipt of the application and the documents by the respondents, Executive Engineer, Water Resources Department, Golaghat Division shall forward the same to the respondent no. 1, namely, Commissioner and Secretary Water Resources Department after having such rectification/verification carried out on the documents submitted by the petitioner for consideration of the claim for pay protection for his earlier service rendered in the Department of Urban Development Department, Govt. of Assam. The Commissioner and Secretary to
Page No.# 3/3 the Water Resources Department shall thereafter process the application of the petitioner in accordance with law. The result of such processing of the application be made known to the petitioner within a period of 3 (three) months from the date of receipt of the proposal from the Executive Engineer, Water Resources Department, Golaghat Division.
Learned counsel appearing for the Water Resources Department is requested to forward a copy of this order to the Chief Engineer who shall thereafter intimate the Executive Engineer and as also the petitioner at their office addresses regarding the disposal of the matter. Writ petition accordingly stands disposed of. No costs.
