It is submitted by the learned Counsel for the alleged contemnor that the contemnor has paid the total agreed amount of Rs.8 crore to the petitioner. It is further submits that other than the 8 crore the alleged contemnor also paid interest of Rs.1,51,25,000/- and as such he prays for disposal of the contempt proceeding. 2. Learned Counsel appearing for the petitioner submits that by an order dated 17th November, 2023 this court on the basis of the undertaking filed by the alleged contemnor has directed the alleged contemnor to pay Rs. 8 crores being the full and final settlement out of which the contemnors shall pay Rs. 1.5 crores being the first instalment on or before 30th November, 2 2023 and the balance amount shall be paid in seven instalments of Rs. 1 crore each for six instalments and 7th instalment shall be Rs. 50 lakhs and the said instalment shall be paid on or before 30th of each succeeding month. 3. It is the case of the petitioner that the alleged contemnor has not paid the amount as per the direction passed by the court and as such in terms of the order passed by this court the alleged contemnor is liable to pay interest. 4. Counsel for the petitioner has handed over the calculation sheet and submits that though the petitioner has received the amount of Rs. 8 cores along with interest of Rs. 1,51,25,000/- but an amount of Rs. 78,94,709/- is still payable being the interest at the rate of 18%. 5. Heard the learned the learned counsel for the respective parties and perused the materials on record. 6. This Court finds that alleged contemnor has paid the total amount of Rs. 8 crore. Other than the Rs. 8 crore the alleged contemnor also paid Rs. 1,51,25,000/- being interest. 7. In view of the above, this Court finds that the petitioner has already received the principal amount as well as the interest of Rs. 1,51,25,000/- thus, this Court is of the view nothing survives in the present contempt application. 8. Contempt application is disposed of. Accordingly GA/2/2025 is also disposed of. 3 9. Rule, if any, issued against the alleged contemnor is discharged and all interim orders passed in the proceeding stand vacated. 10. During the pendency of the contempt proceeding, this Court has appointed the receiver and the remuneration of the receiver of Rs. 3 lakh has been paid by the petitioner. 11. As the contempt proceeding has been disposed of, accordingly, the alleged contemnor no. 4 is directed to pay Rs. 3 lakh to the petitioner within a week from date. 12. It is submitted by the parties as per the settlement arrived between the parties the alleged contemnor has paid the total amount along with the interest. Thus nothing remains in the suit. 13. Accordingly, the suit CS-COM/192/2024 (Old No.CS/70/2020) is disposed of. (KRISHNA RAO, J.) S.De
