PUBLIC PROSECUTOR (AP) The Court made the following: SRK, J Crl.P.No.5135 of 2023 3 O R D E R This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973 has been filed by the petitioners herein/Accused Nos.1 to 5, to quash the proceedings in Calendar Case No.321 of 2023 pending on the file of the Additional Civil Judge (Junior Division)-cum- VIII Additional Judicial Magistrate of First Class, Gannavaram (XII Additional Metropolitan Magistrate, Gannavaram) arising out of a case in Crime No.83 of 2022 of Gannavaram Police Station, Gannavaram, Krishna District, registered against the petitioners herein/A1 to A5, for the offences punishable under Sections 341, 323 and 506 read with 34 of the Indian Penal Code, 1860. 2. When the matter is taken up for hearing, learned counsel for the petitioners/A1 to A5 submits that subsequent to filing of the Criminal Petition, Calendar Case No.321 of 2023 pending on the file of the learned Additional Civil Judge (Junior Division)-cum-VIII Additional Judicial Magistrate of First Class, Gannavaram was transferred to the file of Principal Civil Judge (Junior Division)-cum-Judicial Magistrate of First Class, Gannavaram and it was renumbered as Calendar Case No.87 of 2024 and the said case was disposed of, and the petitioners/ A1 to A5 were acquitted of the said offences and in view of the same, the cause in the Criminal Petition does not survive for adjudication, rendering the Criminal Petition infructuous. SRK, J Crl.P.No.5135 of 2023 4 3. Recording the said submission, the Criminal Petition is dismissed as infructuous.
