Learned counsel for the appellant would submit that the appeal was filed challenging the order of acquittal rendered by the learned Magistrate for the offence under Section 138 of the Negotiable Instruments Act, 1881, and that, pending the appeal, the matter was settled between the appellant/complainant and the respondent/accused. Therefore, the appellant may be permitted to withdraw the appeal. 3. Learned counsel for the respondent/accused would also submit that the matter has been settled out of the Court. 4.
