Affidavit of service filed by the petitioners and report submitted by the State are taken on record. None appears for the private respondents despite service. Heard learned counsels for the parties. The petitioners allege that the private respondents are raising obstruction in construction of boundary wall in their property. The petitioners lodged several complaints in this regard which were not acted upon. It appears from the report submitted by the State that pursuant to the complaint lodged by the petitioners NCR has been submitted under Section 107 of the Code of Criminal Procedure against the private respondent nos.4, 9 and 10. Since the petitioners allege that they are obstructed by the private respondents from raising a boundary wall in their property, they are at liberty to take necessary steps before the appropriate forum. 2 In the meantime, the police authority shall keep strict vigil over the area in order to avoid any untoward incident due to the strained relationship between the parties. The police shall also ensure maintenance of peace and tranquility. With the above observation and direction, the writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
