P. …… 06/05.01.2026 It reveals from the order dated 10.11.2025 passed by this Court and also from the letter received from the Superintendent, Loknayak Jayprakash Narayan, Central Jail, Hazaribagh, the appellant- Darshan Singh had died on 15.10.2025 at RIMS, Ranchi and the appellant was aged around 79 years. 2. It appears that this Criminal Appeal has been filed on 25.08.2023 on behalf of the appellant (who was in custody) through the Jharkhand High Court Legal Services Committee. 3. It also appears that the instant appeal was admitted on 02.11.2023 by the Co-ordinate Bench (Justice Ratnaker Bhengra as then His Lordship was) of this Court and LCR was called for. However, from 02.11.2023 till 15.10.2025, no efforts was made on behalf of the Jharkhand High Court Legal Services Committee or its counsel to file Interlocutory Application for suspension of sentence and for grant of bail to the appellant and who was aged around 79 years. Although, they had filed Limitation Petition being I. A. No. 8995 of 2023. 4. Thus, this Court does not appreciate the conduct of the learned counsel appearing through Jharkhand High Court Legal Services Committee and the concerned Secretary of Jharkhand 2 High Court Legal Services Committee and Secretary, District Legal Service Authority, Hazaribagh for not filing the Interlocutory Application within time on behalf of the appellant, who died in Jail without pursuing any Interlocutory Application for suspension of sentence and for grant of bail in helpless manner. 5. As the appellant- Darshan Singh has died, this Cr. Appeal (SJ) No. 589 of 2023 stands abated in respect of the sole appellant- Darshan Singh under Section 435 of the Nhartiya Nagrik Suraksha Sanhita, 2023 and stands disposed of. 6. Let the copy of this order be placed before Hon’ble the Chief Justice and also to the Executive Chairman, Jharkhand High Court Legal Services Committee for the needful and strict direction be given in future, if any panel Lawyer is engaged on behalf of the Jharkhand High Court Legal Services Committee, then, they should remain punctual in pursuing the appeal on behalf of the appellant or on behalf of the convict person, in co-ordination with the Jharkhand High Court Legal Services Committee and the Secretaries of the concerned District Legal Service Authorities.
