After arguing for a while learned counsel for the petitioners fairly conceded that the aforesaid petition has been filed post dismissal of petition CM(M) No. 219/2021 and that the subsequent petition was defective for the reason that the respondent No. 7 who was a necessary party and already stood arrayed as a party respondent in CM(M) No. 219/2021, has not been impleaded as a party respondent in the aforesaid writ petition. 2. He further concedes that he is a necessary party. For that reason, he seeks to withdraw this petition with liberty to file fresh one. 3. Learned counsel for the respondents raise no objections. 4. As such, dismissed as not pressed with liberty to the petitioners to file fresh one in case need arise. 5. Interim direction, if any, shall stand vacated.
