O R D E R 28.07.2026 The petitioner is seeking compassionate appointment in terms of the Jammu and Kashmir (Compassionate Appointment) Rules, 1994 issued vide SRO-43 of 1994. The petitioner is the son of the deceased late Gh Nabi Shah, who is stated to have died in harness while performing his duties in respondent Department as Helper way back in 2013. At the relevant point of time, the petitioner was minor (aged 10 years). It is further submitted that at the time of the death of father of the petitioner, the petitioner was minor, therefore his mother approached the Department seeking compassionate appointment who being physically challenged/ differently abled, could not be considered positively. During the pendency of the claim of the mother of the petitioner for compassionate appointment, the petitioner has attained the age of majority but again the case of the petitioner stuck on account of delay and laches. However, learned counsel for the petitioner, after arguing for some time, submitted that the petitioner will feel satisfied, in case this petition is Isaq Hameed Bhat I attest to the accuracy and authenticity of this document 29.07.26
treated as representation on behalf of the petitioner and the respondents are
directed to consider the case of the petitioner afresh. Keeping in view the averments contained in the petition, this petition is disposed of by providing that respondents shall re-look the case of the petitioner in accordance with law governing the field and shall take a decision positively within a period of six weeks from the date a certified copy of this order is made available.
