After arguing for a while, learned counsel for the petitioners submits that he would feel satisfied in case the Government accords due consideration to the case of the petitioners in terms of the Government policy promulgated vide Government order No. 118-JK(Rev) of 2023 dated 24.08.2023, which has already been placed on record through CM No. 828/2025 in terms of order dated 15.05.2026, provided the said policy is still in vogue. 2. Learned counsel for the respondents is not averse to the disposal of the instant petition in light of the submission made by learned counsel for the petitioners. Accordingly, with the consent of learned counsel for the parties, the instant petition is taken up for disposal at this stage. 3. Since an innocuous prayer has been made by learned counsel for the petitioners, this Court, in the peculiar facts and circumstances of the case, deems it appropriate to dispose of the writ petition at this stage by directing the petitioners to file a detailed representation before the concerned Deputy Commissioner, Kishtwar, within a period of one week from today, seeking due Sr. No. 18 2 | P a g e WP(C) No. 776/2023 consideration of the case of the petitioners in terms of Government order No. 118-JK(Rev) of 2023 dated 24.08.2023. 4. Subject to the filing of the aforesaid representation within the stipulated period, the concerned Deputy Commissioner is directed to accord due consideration to the case of the petitioners strictly in terms of the aforesaid Government policy promulgated vide Government order No. No. 118-JK(Rev) of 2023 dated 24.08.2023 within a period of four weeks thereafter, provided the said policy is still in vogue. 5. The writ petition, in the aforesaid backdrop, is disposed of. 6. In the meantime, till a decision is taken by the Deputy Commissioner, on the representation to be filed by the petitioners in terms of this order, status quo as it exists today shall be maintained. 7. It is made clear that the interim protection granted by this Court shall remain in force till the decision is taken by the Deputy Commissioner on the petitioners’ representation, and the continuance of the same shall be subject to the further orders likely to be passed by the Deputy Commissioner in this regard.
