Heard learned counsel appearing for the Parties. 3. Even though the present Writ Petition has been filed inter alia challenging communication dated 31.01.2023 so issued under Annexure-9 by Opp. Party No.4, wherein claim of the Petitioner with regard to sanction of study leave and consequential protection of his seniority was rejected, but learned counsel appearing for the Petitioner contended that while taking the decision under Annexure-9, since the relevant amendment to the rules made vide office order dated 22.12.2014 under Annexure-11 and 14.08.2015 under Annexure-12 has not been properly appreciated, Petitioner be given liberty to make a fresh grievance before Opp. Party No.4 for reconsideration of his claim as made in the Writ Petition. Page 2 of 2. 4. Learned counsel appearing for the Opp. Parties has no serious objection to the course of action proposed by the learned counsel appearing for the Petitioner. 5. Having heard learned counsel for the Parties and considering the submission made, this Court while not interfering the impugned order for the present, permits the Petitioner to make a fresh application before Opp. Party No.4 for reconsideration of his claim as made in the Writ Petition. 6. It is observed that if any such application is moved within a period of three (3) weeks hence, Opp. Party No. 4 shall do well to take a lawful decision on the same within a further period of three (3) months from the date of receipt of such application. The order so passed by Opp. Party No. 4 be communicated to the Petitioner. 7. Accordingly, the Writ Petition stands disposed of. (BIRAJA PRASANNA SATAPATHY) Judge Jyoti
