Sandhawalia, Chief Justice (Oral) The State has challenged the judgment of the learned Single Judge passed in CWPOA No. 7404 of 2019, titled as Narender Singh vs. State of H.P. and others, whereby the learned Single Judge had set aside the order dated 12.4.2016 denying reinstatement to the petitioner, on account of his acquittal by the Division Bench of this Court vide judgment dated 24th July, 2015 in relation to FIR No. 78 of 2013, dated 11.07.2013, under the NDPS Act, registered at Police Station Bangana, District Una, Himachal Pradesh. The conviction was by the trial Court and the dismissal, as 1Whether the reporters of the local papers may be allowed to see the Judgment? Yes -2- such, was on account of the order of conviction dated 24th March, 2014. Resultantly, the benefit of reinstatement had been granted in view of the fact that once there was an acquittal and no departmental proceedings had been initiated or held against the employee and he was held entitled to reinstatement in service with all consequential benefits vide judgment dated 13th August, 2021. 2. Counsel for the State has placed on record communication addressed to the learned Advocate General dated 27th May, 2026, whereby permission has been sought to withdraw the present LPA on behalf of the State and directions have been issued by the Director General of Police in this regard. The employee has already been reinstated in service vide order dated 13th April, 2022 and thus no purpose would be served by keeping the present appeal pending. 3. In view of the above, the present appeal is dismissed as withdrawn, so also, the pending miscellaneous applications, if any. (G.S.
