Serial No. 34 Regular Cause List. HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR ******* WP(C) 1016/2022 CM(2556/2022). ABDUL QAYOOM BHAT AND OR. …Petitioner (s) Through: Mr. Syed Sajad Geelani, Advocate. VERSUS UNION TERRITORY OF J AND K AND ORS.. Through: Ms. Maha Majeed, Assisting Counsel. …Respondent(s) CORAM: HON’BLE MR. JUSTICE SANJAY DHAR, JUDGE. ORDER 03-07-2026 01. Through the medium of the present petition, the petitioners have sought a direction upon the respondents to assign work to them on a need basis and to give them a preferential treatment as and when the Respondent-Department engages persons for execution of work. The petitioners have also sought certain other directions in the Writ petition. However, learned counsel for the petitioners has submitted that the petitioners are confining the present Writ petition to prayer clause (i) of the petition. 02. The respondents, in their reply have admitted that the petitioners were, at one point of time, engaged as casual workers. However, it is the stand of the respondents that the petitioners were engaged by an incompetent authority and have since been disengaged. 03. One thing is clear that the petitioners have previously worked with the Respondent-Department on need basis and have acquired the experience. The petitioners are now seeking an innocuous relief for consideration of their engagement on need basis by according preferential treatment to them on account of their past experience. 04. Having regard to the nature of the relief being sought by the petitioners, the present petition is disposed of with a direction to the respondents to consider the engagement of the petitioners, as and when the need arises, having due regard to their past experience. 05. Disposed of along with connected CMs. (Sanjay Dhar) Judge SRINAGAR 03-07-2026 Showkat Khan
