01. As per note of the Registry dated 19.04.2024, a notice has been issued to respondent No.3 through SHO concerned which has been received back duly served, however, there is no representation on behalf of respondent No.3.
02. After arguing for a while, learned counsel for the petitioners fairly submits that he be given liberty to pursue the matter before the competent Court where the challan has been filed in the instant petition i.e before the Court of learned District Judicial Mobile Magistrate, Rajouri and accordingly he seeks withdrawal of the instant petition with liberty to appear before the competent Court.
03. In the light of the statement made by the learned counsel for the petitioners, the instant petition is dismissed as withdrawn with liberty as prayed for.
04. Interim direction, if any, shall stand vacated.
