The CRLMC has been filed challenging the order dated 19.07.2022 passed by the learned SDJM (S), Cuttack in 1CC No.356 of 2022 taking cognizance of the offence punishable under Section 403 of the IPC. 2. This matter had been referred for mediation by order dated 15.04.2025 by this Court as it found that the allegation emanates from a monetary transaction. The mediation report dated 06.06.2025 revealed that although learned counsel for the Petitioner was present but the Petitioner was absent and although the Petitioner was contacted over telephone, he expressed his inability to appear before the Court for which a short adjournment was granted. On 06.06.2025 also, the Petitioner did not appear. So due to absence of the Petitioner, the process of mediation was declared unsuccessful. 3. On 15.04.2026, Mr. Mulia, learned counsel for the Petitioner had been granted adjournment of two weeks to obtain instruction from the Petitioner, regarding settlement of the matter. 4. Today, a memo is filed by Mr. Rasmi Ranjan Nayak, learned counsel for the Petitioner stating that despite his attempts to contact the Petitioner, no instructions have been received. Mr. Nayak, learned counsel is present in Court and submits that the CRLMC may be permitted to be withdrawn. Memo is taken on record. 5. Mr. S.K. Sahu, learned counsel is present on behalf of the Opposite Party. 6. In view of the memo and submission of the learned counsel for the Petitioner, the CRLMC is dismissed as withdrawn. 7.
