Order No.
ORDER 20.04.2026
09. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.
2. Heard learned counsel appearing for the parties.
3. Pursuant to order dated 10.03.2026, learned Addl. Govt. Advocate produced the instruction so provided by the Office of Special Relief Commissioner, Odisha with service of copy on the learned Senior Counsel appearing for the petitioner. The same be kept in record.
4. Basing on the instruction, it is fairly contended that no such selection process has been initiated after disposal of the matter by the Tribunal vide order dated 06.12.2013 under Annexure-4 and the only selection
process was initiated on February 14, 2013 to fill up 43 vacant posts of Boat Khalasi within the State Port Engineering Organisation under the Revenue and Disaster Management Department. All such appointments were made vide office
order dated
06.02.2014.
5. Learned Senior Counsel appearing for the petitioner taking this Court to the RTI information available under Annexure-7 series, contended that 43 posts of Boat Khalasi on regular basis have been filled up during the period 2014 to 2021, however, petitioner’s claim is yet to be considered.
6. Considering the submission and the fact that in terms of order dated 06.12.2013 under Annexure-4, no selection process has yet been initiated to consider the claim of the petitioner and since from the RTI information so available under Annexure-7 series, it is found that a number of persons have been appointed as regular Boat Khalasi during the period 2014 to 2021, this Court taking into account the engagement of the petitioner w.e.f. 19.07.1996, while disposing the Writ Petition with quashing of the impugned order dated 11.03.2022 under Annexure-6, directs Opp. Party No.2 to regularize the services of the petitioner with passing of an order within a period of 6(six) weeks from the date of receipt of this
order.
7. The Writ Petition stands disposed of accordingly.
