This CRLMC has been filed with a prayer to quash the proceedings arising out of FIR No. 390 of 2021 dated 23.08.2021 of Chhendipada Police Station which has been registered for commission of offences punishable under Section 20(b)(ii)(C) & 29 of the NDPS Act. This corresponds to CT (NDPS) Case No. 5 of 2021 in the Court of the learned Sessions Judge -cum- Special Judge, Angul. 2. Dr. Janmejaya Ray, learned counsel for the Petitioner submits that in the meanwhile charge sheet has been submitted and trial has commenced in the case. He further submits that a direction may be issued to the learned trial Court for expeditious completion of the trial and a direction to the police, not to harass the Petitioner. 3. In response to a query of this Court, regarding status of the Petitioner – if the Petitioner has been granted bail and is facing trial, he submits that the Petitioner has not appeared in the case as yet but his counsel is representing him. He also submits that the Petitioner has not been granted bail in connection with this case. 4. The CRLMC is pending since the year 2022 and it has been listed today. 5. In view of the submission of the learned counsel that during pendency of this CRLMC, trial has commenced in the case and the Petitioner has not yet appeared in the case and has not been granted bail, I am not inclined to entertain his prayer to issue a direction to the police not to harass him as it is the duty of the police to arrest a person who is accused of committing an offence under the NDPS Act or against whom non-bailable warrant may have been issued for his non-appearance / default in appearance in a Court during trial unless his presence in Court has been dispensed with by the learned trial Court or superior Court. 6. The CRLMC is accordingly dismissed. 7. It is open to the Petitioner to avail of other remedies which are available to him under law, in view of the developments in the case after filing of the CRLMC, if so advised. 8. Urgent certified copy of this order be granted on proper application. 9. Copy of the order be sent to the learned Sessions Judge - cum- Special Judge, Angul by the Registry forthwith.
