1. This matter is taken up through hybrid mode.
2. Heard learned counsel appearing for the Parties.
3. Pursuant to order dt.24.03.2026, learned Addl. Standing Counsel basing on the instruction provided by the Addl. Secretary to Government, Department of Water Resources so issued vide letter dt.07.04.2026 contended that pursuant to the earlier order passed by this Court in W.P(C ) No.18429 of 2022, claim of Shri Ramesh Chandra Majhi was rejected vide order dt.13.02.2023.
4. At this point of time, Mr. Rabindra Nath Prusty,
learned counsel contended that challenging order dt.13.02.2023, Shri Ramesh Chandra Majhi has filed a Writ Petition in W.P.(C ) No.11741 of 2023 and the said
Page 2 of 2. Writ Petition was admitted with issuance of notice vide
order dt.25.04.2023.
5. This Court is quite astonished with the instruction provided by the Department, having no knowledge about the filing of a subsequent Writ Petition by Shri Ramesh Chandra Majhi vide W.P(C ) No.11741 of 2023 with issuance of notice on 25.04.2023. This clearly shows the apathetic attitude of the Department in dealing with the matters concerning the Department.
6. This Court directs Registry to issue a copy of the
order to the Secretary of the Water Resources Department, Govt of Odisha to take appropriate action in the matter.
7. However, as requested by Ms. N. Patra, learned counsel appearing on behalf of Mr. P.K. Mahapatra,
learned counsel for the Petitioner, list this matter on 23.04.2026 along with W.P.(C ) No.11741 of 2023.
